Lawyer Salary Australia: Award Rates, Casual Loading, and Super Paid on Top
Under the Legal Services Award 2020, a law graduate (Level 5) earns $33.99 per hour, or $1,291.80 per week for 38 hours, with super paid on top.
Lawyer Salary Australia: Award Rates and Calculations
When researching a lawyer salary Australia, the first place to look is the Legal Services Award 2020 (MA000116), which sets the minimum pay rates for legal clerical and administrative employees, law graduates, and law clerks. The Fair Work Ombudsman updates these rates each 1 July. From 1 July 2026, the award minimum wages increased by 4.75%, consistent with the national wage review.
Minimum Rates Under the Legal Services Award
The award classifies employees by level. For a law graduate (Level 5), the minimum weekly rate is $1,291.80 for a 38‑hour week, which works out to $33.99 per hour. A law clerk (Level 6) earns $1,369.20 per week, or $36.03 per hour. These are the base rates for full‑time and part‑time employees. Casual employees receive a 25% loading on top of these rates—more on that below.
If you are not covered by an enterprise agreement, these award rates are your legal minimum. The National Minimum Wage is lower at $26.44 per hour ($1,004.90 per week), but the award overrides it for legal workers.
Converting Hourly to Annual, Fortnightly, and Weekly
To estimate an annual salary from an hourly rate, use the formula:
Annual gross = hourly rate × hours per week × 52
We assume a standard 38‑hour week, as defined in the award. For a law graduate:
- Hourly: $33.99
- Weekly: $33.99 × 38 = $1,291.80 (matches the award table)
- Fortnightly: $1,291.80 × 2 = $2,583.60
- Annual: $33.99 × 38 × 52 = $67,173.60
You can use our hourly conversion tool to run your own numbers. Remember, this calculation assumes the same rate every week, no unpaid overtime, and no penalty rates or allowances.
Casual Loading: 25% on Top
If you work as a casual employee, the award requires a 25% loading on the minimum hourly rate. This loading compensates for the lack of paid leave, public holidays, and other entitlements. For a Level 5 law graduate:
- Base hourly: $33.99
- Casual loading: 25% = $8.50
- Casual hourly rate: $42.49
Our casual loading page explains how to apply this correctly. Never enter a rate that already includes the loading into a calculator that adds it again—the loading is applied on top of the base rate.
Superannuation Paid on Top
Superannuation is not included in the hourly rate. Under the Superannuation Guarantee, your employer must pay an additional 12% of your ordinary time earnings into a super fund. This is on top of your gross pay. For a law graduate:
- Super per hour: $33.99 × 12% = $4.08
- Super per week: $1,291.80 × 12% = $155.02
- Super per year: $67,173.60 × 12% = $8,060.83
There is a maximum contribution base of $270,830 per year. Once your ordinary earnings exceed that, the employer does not have to pay super on the excess. For most lawyers under the award, this cap is not reached. See our super and packaging guide for more details.
Tax and Take‑Home Pay
Your gross annual salary is taxed using the 2026–27 resident tax rates:
- Nil tax on the first $18,200
- 15% on income from $18,201 to $45,000
- 30% on income from $45,001 to $135,000
- 37% on income from $135,001 to $190,000
- 45% on income over $190,000
Plus a Medicare levy of 2% (based on the 2025–26 single reduction thresholds, as 2026–27 thresholds were not confirmed). For a law graduate earning $67,173.60:
- Tax: $18,200 × 0% + ($45,000 – $18,200) × 15% + ($67,173.60 – $45,000) × 30% = $0 + $4,020 + $6,652.08 = $10,672.08
- Medicare levy: $67,173.60 × 2% = $1,343.47
- Total tax and Medicare: $12,015.55
- Annual take‑home: $67,173.60 – $12,015.55 = $55,158.05
- Weekly take‑home: $55,158.05 ÷ 52 = $1,060.73
- Fortnightly take‑home: $1,060.73 × 2 = $2,121.46

Comparing Award Rates to Market Surveys
Recruiter surveys often report higher “market” salaries for lawyers, but those figures may include bonuses, allowances, or above‑award payments. The Fair Work Ombudsman’s award rates are the legal minimum. For a reliable benchmark, the Australian Bureau of Statistics publishes Average Weekly Earnings. In May 2026, full‑time adult ordinary time earnings were $2,083.70 per week, which is higher than the award rates for law graduates. However, award rates are the floor—many lawyers earn more under enterprise agreements or individual contracts.
Using the Timesheet Calculator
Our timesheet lets you enter a base hourly rate and optionally add casual loading. It then calculates weekly, fortnightly, and annual figures, plus super and estimated tax. Always use the base rate (without loading) in the hourly field, then tick the casual loading checkbox if applicable.
Summary
A lawyer salary Australia under the Legal Services Award starts at $33.99 per hour for a law graduate. With casual loading, that rises to $42.49 per hour. Super is paid on top at 12%. Use the formula hourly × 38 × 52 to get annual gross, then deduct tax and Medicare for take‑home pay. For award rates, allowances, and penalty rates, refer to the pay guides published by the Fair Work Ombudsman.
This estimate assumes consistent hours, no unpaid overtime, no salary sacrifice, and no HELP or Medicare levy surcharge deductions. It is a guide, not a binding determination of your pay.
